With the Membership becoming aware that the VFW Dept. Of Texas was CONSPIRING (TPC § 15.02) to ENGAGE IN ORGANIZED CRIMINAL ACTIVITY (TPC § 71.02) to::
1. Intentionally and deliberately submit a FRAUDULENT AND FALSE STATEMENTS TO THE IRS (26 USC § 7206) on or about 12/17/2018 erroneously conveying that FEIN #82-2717893 was a “Subordinate Unit” under IRS Group Exemption #1723, without first receiving signed written approval and authorization from the Post to do so.
2. The intentional and deliberate CONSPIRACY TO COMMIT (18 USC § 371) BANK FRAUD (18 USC § 1344) by unlawfully preparing, signing and submitting, false and fraudulent official VFW documents to the SSFCU; that erroneously conveyed ownership and control over the Post’s account and affecting the unlawfully removal of Steve Mueller as a duly authorized Signatory and adding of John Shipley, without receiving any signed written authorization by Mueller or the Post Membership to do so.
3. The Malicious and intentional act of conspiring to prepare, sign and publish a completely fabricated and erroneous Article 9 Disciplinary Action against Post Members Mueller and Pino, accusing them (among other ridiculous accusations) “THEFT” of Post monies (Even though NONE of the Post Membership (including all of the Post Officers and specifically the Post Trustees) had already confirmed that these erroneous and malicious allegations were false and without merit).
These revelations and the fact that the VFW Dept. Of Texas refused to explore administrate remedies or even “Negotiate” a reasonable solution, resulted in the POST MEMBERSHIP VOTING UNANIMOUSLY TO IMMEDIATELY AND PERMANENTLY TERMINATE ANY AND ALL ASSOCIATION WITH THE VFW & THE VFW DEPT. OF TEXAS AND RENAME THE ORGANIZATION.

The FABRICATION of an additional “Signed Incident Report(s)” is not necessary if Special Order #18 & 19 were initiated complaint with provisions prescribed in Article 9 of the VFW National By-Laws and Manual of Procedures. However, Neither Special Order #18 or #19 are compliant, as the “Signed Incident Report(s)” provided by Post 6970 Commander (John E. Shipley) and Post 4853 leadership (Jeff Rankin, Patricia S. Hewitt and Douglas Edwards) and Shipley’s subsequent “Investigative Report” only act to reaffirm and assert the erroneous claims of “Fundraising outside of a area” and opinion of “behavior unbecoming an officer”. No Signed Incident report existed on or before 02/06/2019 to establish the Financial related allegations contained in Special Order #18 or #19, or was confirmed by any “Investigator”, “Investigative Committee” or affirmed in any “Investigative Report” (as required by Section 901 of the VFW National By-Laws and Manual of Procedures).
Since the VFW Dept. Of Texas had already Filed a FALSE POLICE REPORT (TPC § 37.08) and submitted numerous FRAUDULENT and TAMPERED WITH AND FABRICATED EVIDENCE (TPC § 37.09), prepared for the sole purpose to convey that Mueller and Pino were Guilty of MISAPPROPRIATION OF FIDUCIARY PROPERTY (TPC § 32.45) with the Pleasanton Police Department on 03/13/2019 (Incident #1900277) and since the allegation of Financial misconduct was never investigated by anyone: The FABRICATION of a NEW “Signed Incident Report” (DA2_01525), “Order appointing an Investigator” (DA2_01528) and “Investigative Report” (DEF_00489-00493), that followed the National VFW Investigative Report format (DEF_00590-00593) that specifically related to the subject of Financial Misconduct would be required to be created in order to “properly Initiate” a (now entirely “NEW”) Article 9 Disciplinary Action against Mueller and Pino.
This FRAUDULENT and UNLAWFUL action to knowingly Conspired to Prepare and sign a FALSE official document of the VFW, was not only condoned by the National VFW, but encourage by assigning David Prohaska to assist and Collaborate in its FABRICATION.
With the “Investigative Report”, now titled “Report of Investigation”, the 3rd Version asserting that Mueller and Pino now have Misappropriated $10,741.18 instead of the previous claim of $9,751.02 (contained in Special Order #18 for Mueller), or $4,987.57 (contained in Special Order #19 for Pino), or $10,101.05 (as reported to the Pleasanton Police Report in the specifically created “Texas VFW Investigative Report/ Prosecution Guide” on 03/13/2019. A total of eleven (11) erroneous and completely fabricated variants and versions of the required “Investigative Report” were published by the VFW Dept. Of Texas, prepared and signed by John E. Shipley, Daniel L. West and/or Andrew F. Camplen between 11/30/2018 and 04/23/2019 that reflect different dates and alleged misappropriated amounts. None of these “Investigative Reports” are consentient with the alleged Misapplied amounts reflected in Special Order No. 18 delivered to Mueller on or about 02/10/2019, Special Order No. 19 to Pino on or about 02/12/2019, Special Order No. 27 delivered to Mueller on or about 04/23/2019 or Special Order No. 28 delivered to Pino on or about 04/23/2019. Collectively, these numerous erroneous documents reflect an inconsistent and Fraudulent alleged Misappropriation amounts between $4,987.57 and $10,741.18. A difference of more than $5,753.61. Leaving little doubt that allegations are FALSE and the documents were obviously created by incompetent Fuck-ups and Retards.

Section 903(i)(10) of the VFW National Manual of Procedures states, “In the event
the accused or their counsel was not present at the hearing” requires “a copy of the

Mueller did NOT attend any Disciplinary Hearings on 05/22/2019 or 05/23/2019.

It is not submitted by the “Department Commander initiating the disciplinary action”, nor does Conley “expect to be a witness with respect to factual matters”. The letter clearly indicates Daniel L. West’s (the apparent “Accuser”) selections for the makeup of the Disciplinary Panel, who his choices are for the “Panel President”, the “Prosecutor” and West’s choices for the date, time and location of the Hearing.

West knowingly, intentionally and with blatant disregard for the VFW National By-Laws or Manual of Procedures, conspired with Andrew Camplen and others, to prepare and make false statements in and to FALSIFY and submit fraudulent, FABRICATED, signed official VFW documents into an official government record concerning the criminal investigation of Steve Mueller and Stephanie Pino, with the intent to embarrass them as VFW members in violation of VFW National By-Laws Section 902(2), 902(4), 902(6), 902(7), 902(8), 902(10), 902(11) and 902(12).
The statements given to Det. Jorden Haren is a intentional criminal act of AGGRAVATED PERJURY (TPC § 37.03).

Membership complaints were received by the National VFW, specifically David Prohaska, Kevin Jones and Vincent BJ Lawrence, however they were ignored, as no action to date has ever been initiated by the National VFW to investigate the complaints made by the Members, nor has any excuse been given by the VFW National Commander-in-Chief to convey as to why he decided on not look into them.
Believing that the National VFW and Dept. Of Texas had no desire or intent to assist AVC, Mueller or Pino (Plaintiffs) with an administrative solution and in order to correct the public record, the Plaintiffs had no choice but to entertain a legal remedy addressing the FALSE and Defamatory statements that had known to have been made by the VFW Dept. Of Texas Commander Ingeborg A. Conley, Adjutant/ Quartermaster Roy J. Grona & Daniel L. West, Andrew F. Camplen, Post 6970 Commander John E. Shipley and Post 4853 Commander Jeff C. Rankin, Adjutant Patricia S. Hewitt and Douglas Edwards.
Pleasanton Police Department Detective Jordan Haren contacts Mueller and Pino late in the evening informing them that a Arrest Warrant has been issued for them. Neither Mueller or Pino were in the County, but Mueller advised Haren that they will fully cooperated and travel back to Atascosa County to surrender.
At 0700 hours, Mueller and Pino formally surrendered to the Atascosa County Sheriffs Office (ACSO) for processing (the only jail facility in Atascosa County). After being asked to wait for any hour in the waiting room, Pleasanton Police Department (PPD) arrived, handcuffed and transported both Mueller and Pino to the PPD for the sole purpose of taking photographs. After these photos were taken, both Mueller and Pino were promptly transferred back to the ACSO facility to be photographed, fingerprinted and booked into jail. The unofficial “staged” photos taken by the PPD for propaganda purposes, were later released to numerous Media outlets and were showcased on the PPD’s Facebook page immediately drawing scorn and negative comments from the community.

AVC, Mueller and Pino gave the VFW, VFW Dept. Of Texas and all of the coconspirators the opportunity to retract their false statements, but with the Malicious Criminal Prosecution obviously going forward and knowing that no Financial Misconduct occurred at AVC and thus unaware of what False and Fabricated information had been submitted to the Pleasanton Police Department that could have possibly be used to support probable cause of a crime. Mueller and Pino DEMANDED the retraction of ALL false statements made that they had become aware of to this point in time.
